What she said really makes no difference, it's the driving that matters. Stick to the facts of the incident, not the aftermath. That's all the insurers/lawyers care about.

Revised version, the work of but a moment!

Do you think it worth showing the left and filter lane? So emphasising why Tom was going ahead. Is there an exit to the left of you car for traffic already on the roundabout to get to the M40?

A lady ran into the back of my daughter when she stopped at the entrance to a roundabout, and claimed it was my daughter's fault for stopping. She refused to admit liability or notify her insurer, so I took her to the Small Claims Court, as my daughter only had a third party policy.

I'm old-fashioned enough to think that if you run into the back of someone, you are at fault. If I did something like that I would put my hand up and admit it. To say that I was gobsmacked, when the Court Arbitrator ruled that my daughter was one third to blame for the accident, is an understatement!

I don't think it matters. What's relevant is that she drove into the back of him (assuming the pic is correct).

One other thought... can you not call upon these Highways Agency chaps to support your claims and refute hers?
