The name in the V5 ie his wife, may be the registered keeper of the vehicle, but that does not make her the owner.
If he has a purchace invoice in his name then the car legally belongs to him and she has no entitlement to sell it.
Whether he takes it further is another thing!

As far as i am aware and speaking to rozzer over road it is possible to do this.
As long as you have the keys especially the master and the V5 then the car can be re-registered with DVLA after a period of time and if you have the logbook then there is nothing to stop you selling it.
Do the HPI check for crash and finance if that is clean then no reason to question if its the owner or the spouse you see when looking at the vehicle and good trick when you meet person ask to do checks and calls ( from mobile of course ) in the house as they could have driven to any old house.
So if your smart re-register with dvla then get keys and bobs ur uncle you keeper of the car and can sell it, theres no come back for the owner of the vehicle as he does not have keys or even the v5 just an old logbook with his/her name in it and police class as a civil matter so not interested, go through the courts. good old police.
I keep my keys well hidden and away from the V5 and that seperate from logbook and all locked away in different places for just this reason.
