You asked for opinions and then didn't like what you were told, quite comical really and nothing to do with people being keyboard warriors at all!

id be very carefull.... go though the insurance or if he does excpet cash or replacment parts make sure you get it all signed that thats the end of the matter and in 6 months time you dont get as mentioned the ' my back hurts or whiplash comments... '

You need to inform your insurance company regardless. I think it is illegal not to.

My scenario.

I parked a 1 yr old car on a slight slope with hand brake on.
Brakes cooled and handbrake slipped.
Car rolled 20 ft into back of parked RangeRover
bent front of my car in and bent bumper/rear of Rangerover.

Took my car back to garage and handed to to them advising the situation. told them their issue - manufacturing fault - sort it.

manufacturer spent some time analysing brakes and confirmed incorrect set-up and assumed blame.

manufacturer fixed my car and rangerover FOC. lending me car in interim

I contact my insurance company and advised the situation. They contacted manufacturer and requested a letter of confirmation that all future claims that may be made off the back of this would be absorbed by maunfacturer.

Manufacturer sent said letter to insurance company and insurance company placed on file. Insurance company no longer held any future claim risk and was happy. they have placed a non blame / claim accident on my record but this did not affect my premium year on year after. I think it has been removed now actually.
