this happened to me in my old car, hit a brand new clio, minimal damage to mine but a new bumper on hers. she seemed genunine and she must have thought the same about me so she got it fixed an sent me the bill.

saved me from having a crash on my records

id say buy him a new car if your both happy with that. save you money in the long run with insurance quotes.

no he wouldn't

it might help any future claim, but it certainly wouldn't bar him

that's time limited

injuries are supposed to be reported to the Police, and you would also expect them to be reported to a Doctor

but there may be no known problems at the time of the accident

if this were to happen the insurance would surely be asking for witness statements etc to the incident?

there were none!

be just like any other dispute

burden of proof etc etc

I'm no lawyer, but the starting point would be the fact that you had bought the other bloke a new car/repaired his old one

that looks like an admission of guilt to me

not good

people are convicted of murder without any witnesses, so I wouldn't put too much weight on the fact that were no witnesses in your case

moreover, as I understand things, the burden of proof is lower in a civil case (which I think a damages claim would be)

I think we're gaining nothing speculating on what may happen! Wait 'til the dude gets back, offer him a new car, take it from there!

The only issue is the possible injury claim, that can run into

Gad is quite right, I still think neither of your reporting the accident would harm his case in court but you would do well to get him to admonish you of further liability in writing.

And make sure all transactions are in cash, so when he comes back with the injury claim, and he says you bought the new car for him because you hit his old one, there is no paper trail (other than this thread ) of it. Just say you never saw him before in your life.

Tell you insurance, let them sort it out.

If it is cheap enough then reimburse them. if not make the claim. Either way you havent done anything wrong and you won't be kicking yourself afterwards.

I will be doing this for sure, and I will buy the car in cash or what have you.


I think people prefer to go the insurance route to easy nowadays, the biggest issue is obviously this no win no claim crap that is so rife in todays society.
