Most claims = a 2 year step back so you ought to be 1 years NCB. However if you can actually buy the guy a car for less than it's going to cost you then perhaps it will be better if you find a car with him or agree a value for the car and give him the cash?
The thing about suing you for whiplash is absolutely spot on though, course he would have had to report it to the police at the time of the incident.

this is what I want to do is either buy the car off him, supply an alternative subject to his agreement or do the repair. It will probably be cheaper to supply a alternative or buy his car rather than the repair route.

You can always settle the insurance claim value once the claim has been closed. This way you keep your NCB and interestingly it is then known as a 'non fault accident'. Wierd
