Intent is beside the point you can commit a criminal act without the intent of doing so, the intent will only be taken into account in mittigation. The fact remains that this persons actions directly resulted in damage to the OP's car for which he must clearly be held liable.

Drunkk and disorderly is an offence and if he could not help himself, but to fall about, he was obviously guilty of a criminal act.

Gareth's incident was a little different; there could've been money to be made from it for deception/fraud.

There IS another problem with reporting it; queueing up for hours in a sty, with the scum of the earth, until some duty officer deigns to treat you with utter disdain.

I realise it's necessary, but the police's timewaster filtration service leaves a LOT to be desired.

Obviously, the expreience is a lot nicer if the sty is in a nice area, but filing a report in scumsville is right unpleasant.

Get your local stations phone number, and report it, i've found them to be really polite. No need to go to the station IMO

The longer you leave it the less likely anything will be done though.

It's actually been illegal since the 1800's to be drunk in a public place in England.

So anyhow, how is our friend going to prove the 'culprit' was drunk and disorderly?

Drunk and disorderly is only an offence in a public place, it does not apply to private parties.

Does not have to, I was really reittering the point that there does not need to be intent for a crime to be comitted

QUOTE (Stiggywig @ Jul 2 2008, 07:05 PM)
There was no criminal intent therefore no offence.

Not true, who intends to get so blind drunk they cant walk propperly?

Does this mean if I go through a red light because the sun was in my eyes, that I get off scot free simply because I did not "intend" to do it? Of course not.

Just report it and used your insurence legal cover, 3 witnesses, no cost to yourself, initial statment is all is needed most likely. Let your cover so the work you can more or less forget about it. IT COSTS NOTHING TO TRY!

Otherwise forget about it, pay for it yourself, theres no other options!

If the offender fell on the OP's car he clearly was not in a private party, or for that matter his own home. Therefore it was a public place or he was tresspassing on someones propperty.

Like I say, seems to depend entirely on the area.

Might try the phone approach next time.
