s 13, sale by description, an implied term, condition, not warranty, applies to all transactions, private or commercial. Thus this bloke, if he had an intra England deal, could sue, if he could find him
I'm sure its all kind of irrelevant though, as this guy is in Canada and I know fack all about 'cross border' relationships, unless they are European based.
Maybe an expert on here could shed some light, re: the UK/Canada thing.

The Sale of Goods Act gives the buyer a reasonble time to inspect.
I'm not going to go into the relevant international conventions (basically because I'll be reading it from the notes to the SoGA as I type it ) but your first port of call re contractual recourse will be the ebay terms and conditions.
I would point out that Canada, being a commonwealth country, will have similar laws I suspect (Australia being a good example).

i would offer to help but since he does not live in southampton looks like you out of luck... if you can get any more details on him and he does live on the south coast (not up in london) i may be able to help you. southampton is about a 30 min drive for me

omgvtec this looks very similiar to a hardtop that i saw in silverlake breakers in Botley, Southampton about 2 months ago.
just thought i would check them in case it was the same one but they do still have it.

I would report him on Ebay, I have used this before and they are pretty hot, if you have used ebay mail to converse they will have an audit trail of the mail, so can veriofy what was agreed.
They will also freeze any monies in his paypal account, and as you paid by paypal you are guaranteed a refund I think up to
