Clutch Problem

Clutch Problem
My warranty on my 01 runs out next month so I have taken the S back to the garage today to get a few things sorted.
One of the main issues is that the gear box feels quite lumpy at the moment, more so between gears 1st 2nd & 3rd, the others being quite slick. If im stationary and go from neutral to 1st, you feel the whole car bite with a jolt.
I took the technician out for drive to show him the problems and he reckons its all down to the clutch.
Now the problem is because the car has done around 52k miles, they believe Honda will see it as wear and tear and not an actual fault with the car, therefore not beng covered by warranty and me footing the bill - ouch!
To be honest I'm actually hoping it is something serious and therefore gets fixed for free before the warranty expires.

Anything over 40K then it's wear and tear - 780 of your finest pounds unfortunately
