I remember that thread. It will be interesting to see lou's response to this thread, if he still reads this forum.

I was just about to look for that thread wadswoaj when I read the first post. Doesn't seem like it's the first time Lou has done something similar. Be interesting to hear his side of the story.

There really does need to be 'consideration' (some form of payment) in order for a contract to be established - but there is case law, which I (or someone else) will look up which concerns a very similar issue. I suppose the HPI is (in a weird way) consideration - it wasn't paid to Lou but, it was an expense in the direction of the vehicle - that would take some arguing though ! I don't believe there is a contract here though.

At the very least though, Lou needs to be given the chance to post his side of the story.

If I were you? - put it down to experience. I understand the out of pocket issue and annoyance but pursuing this would be pretty pointless now. Where would it get you? Except for even more out of pocket.

I would look for another S.

Lou, what is your take on the story?
Not quite right. If the buyer has agreed to pay the

I could be completely wrong but I seem to remember a similar thread from somebody who was buying something from Lou s2k that ended up in a similar situation....... it was something along the lines of the buyer agreed to purchase something and asked Lou if it was ok to collect a week or two later....... by the time the guy was ready to pickup the item had been sold to somebody else.

If it wasn't Lou I unreservedly apologise but I'm 99% sure it was........

EDIT: 100% sure....: https://www.s2ki.com/forums/index.php?showt...0&#entry7653438
I thought it was the same guy Phenom dealt with........ once can be excused as an accident, twice is surely lack of morals

From a buyers point of view I would have placed deposits in both cases, but if you have someones word........

I think it's unfortunate and personally I wouldn't do the same.

However, unless your mate put down a cash deposit to secure the car then I'm afraid he has to accept the consequences........ I don't know anything about the legal aspects of entering into a contract etc in a case like this but as far as I'm aware a gentlemens agreement doesn't really mean squat. If he wanted the car and it was a good 'un why didn't he put a deposit down on it??

There is always 2 sides to a story but just my humble opinion

Whether there's a contract as a matter of law is one thing. Whether there's a moral obligation to give nattcharles' mate first refusal, having previously agreed a price, is quite another.

Sounds pretty shoddy on the face of it - and not the first time this accusation has been levelled at Lou. But let's see what Lou has to say for himself before rushing to judgment.

From the first post, I immediately remembered that this has happened before with Lou being involved.

Hopefully he will give his side soon.
