That's a great link thanks for that MB, now I just need to determine my diameter of pipe and get one bought I think

EDIT:: the one thing I will say on further investigation is that the filter has to be completely submerged for hydrolock to potentially happen, rain is not enough, there has to be a vacuum created. This would be pretty difficult to do I guess, I suspect a small but wide and 12" or more deep stream of water or similar would be the type of thing to avoid, as this might give the potential for a lock.

Using that example shows a problem with this!
Air (or water) is going to take the path of least resistance.
Putting this in is going to negate the lower section of the AEM IMHO
The majority of the air will be pulled through this item rather than the inner wing area of the AEM.

Yes thats what I thought, but no ... it is sealed rubber flaps inside and the normally are sealed so the air goes through the pipes, only when there is a vacuum at the filter end do they open and allow the air to be sucked in through the sides of this device. If you look at the link MB posted there are pics of how it works, it's rather sophisticated, it looks simple but not so.

I measured my pipes, and had a look at them (both pieces) the diameter of which are 9.5", I have no idea which size of valve I should by as there are 3 or 4 from which to choose, anyone have any idea?

I believe falling rain isn't a problem, the only problem is standing water and deep standing water deep enough to cover the filter under the car, if this happens then water can theoretically by sucked up into the engine causing the hydrolock this device reputedly stops from happening.

Seriously I wouldn't bother, you really do have to drive through a lake to get lock.

As I said, most happen after being parked up overnight with heavy downpour, the high idle rate of the s2000 sucks the water up when you start the engine.

You've taken reasonable precautions already by blocking the drain plug, but go for it if it'll give you piece of mind.

Hmm no i don't think it does, I think it attaches between the two connecting pipes that make up the CAI, but the diameter of these pipes is 9.5 inches the device is sold in 2.5" - 3" but I am guessing this is width, it doesn't make sense I will give them a call next week and in the mean time I will not worry about it and as Dave points out he has driven it through many miles without problem!
