Courts tend to take into account not only what did happen but what MIGHT have happened given the time, location etc etc.

you are charged and convicted of an specific offence
for example, illegal possession of certain firearms results in a mandatory minimum sentence of five years in jail
nothing to do with what you might do with the firearm(s)
same with racing - you were racing, and the decision has been taken that the offence carries a certain penalty
if you crashed, it's fair to assume you would face additional charges
whether the sentences are appropriate or not is an endless debate

Actually, i've had an idea. Why not just ban fast cars? All cars should have a top speed of 90mph and accelerate from 0-60 in no less than 10sec. Surely buying a fast car makes you want to drive fast, otherwise you wouldn't have bought it? 1-0 me.
