I heard of a former schoolfriend who was done last year for doing 100 in his Elise on a straight bit of single carriageway A road. He was fined a few hundred, and had a 14 day ban - were it not for the fact that he was a firefighter, and had a pleading letter from his boss, he would have been banned for a month apparently.

Doesn't sound good. This advice was offered by a magistrate who posts in 'Law and Related' on 5ive-0.com in relation to a guy caught doing 97.5 mph on the motorway. Only really relevant to this thread insofar as it shows the magistrates have to operate within fairly strict guidelines, and gives some indication of factors they're bound to consider...
The guidelines (note guidelines - not instructions) say that for a speed of more than 21mph in excess of limit but not over 30 in excess of limit, in other words 97.95 in a 70 you can expect 4 or 5 points and a fine equal to 1 weeks pay.
BUT the bench have leeway to increase/decrease and will want to look at :-
weather, amount of traffic, distance travelled at the excessive speed (2.5 miles don't look good - after all if you had been paying attention you would have noticed the patrol car) your previous motoring record (not only speeding but careless/dangerous driving). They are also under a duty to increase the penalty if the offence/place of offence/age group of driver/other circumstances are appearing too often in the locality.
if any of these apply it could push up to 6 points & fine equal to 1.5 weeks pay plus possible short disqual (min 14 days, max 56 days). the fines would reduce by up to 30% for a guilty plea.
I would always advise you to attend court. the prosecution is there to prosecute and will not put any mitigating factors (good weather, no other cars etc.). if you can get to a court before your big day to observe the procedure that would help. Ring the local Mags court offices (number in phone book) and ask when motoring cases are heard. just watching for an hour or so will put your mind at rest. the decision to hire a lawyer or not is one for you. if you do decide to represent yourself the court clerk is obliged to help you to present your case (note HELP - not do it for you)
your comments when stopped will help you - lots of people say it was safe to speed because of their exceptional driving skills and look stupid when forced to admit thet hadn't noticed the car with the blue lights on.
what ever you do don't say "its a fast road"
Good luck - come back if you need more help. The guidelines (note guidelines - not instructions) say that for a speed of more than 21mph in excess of limit but not over 30 in excess of limit, in other words 97.95 in a 70 you can expect 4 or 5 points and a fine equal to 1 weeks pay.

Got caught doing 109 MPH on a 70 mph dual carriageway last week (see separate thread).
I intend to follow the advice on here and wear a suit, have a shave, turn up to court, be polite, apologetic, admit the offence and hope for leniency. It's the best you can hope for really.
Will be interesting to see if we are "awarded" a similar punishment.
