That's a lot of mystery miles on a car whose sole purpose in life is to be driven in a spirited manner. Unless you knew the previous owner, it's impossible to blame the car. I'd get it fixed and move on.
I agree that your aftermarket warranty should cover the repair if it's explicitly stated. Yet another reason I don't buy extended warranties.

But does the warranty cover "axles" or "CV joints"? It sounds like the CV joints are the problem, not the actual axles. If you think the warranty should cover them, maybe you should have an attorney take a look at it.
Either way, 90K miles isn't that bad for replacing CV joints. Who knows how the previous owner used/abused the car? Like I said, I replaced mine at 140K and 160K on my Accords, and those cars were driven very delicately compared to how I drive my S2000.
