I will still be putting in the request to use all oem parts, but I spoke with someone at the insurance commissioners office and he informed me that with any exterior (sheetmetal) parts, they can legally use any third party or even used parts if they want.

I can request to use oem parts, but at my expense.

But since I will be getting compensated for the diminshed value, whether now or later in court, I will be making that request to use the original parts on the car and not some sourced parts from china. So I completely agree with you Barry, they are 100% at fault and they should be responsible to have my vehicle back in the same condition that it was in before they recked it.

I just know that this will be a real battle that I don't want to have to go through, and in my eyes I shouldnt have to go through, but that is just how these companies work.

Thanks for all your help guys and I will keep you posted with any progress.

when i had my accident, state farm requested I go to master collision, and they said they only use honda parts. you don't have to accept their 'offer' to use that body shop or used parts.

How do you determine or calculate diminished value?

I don't exactly know yet. That is one of my battles that I am not looking forward to.

Like I said I will be putting in the request for oem parts, but I am just preparing myself to have to be able to put up a fight for this also. Unfortunately as stated earlier according to the insurance commissioner it is COMPLETELY legal for them to use non-oem/new parts on any exterior sheet metal, so this will be a long tough battle I am sure just to get my damn car back to the condition it was before this re-tard (hangover humor) damaged my vehicle.
