Nice summary of the legal strategy, Bill. I can't think of anything to disagree with there.

However, just a thought... regarding the expert, I would think that would be tricky to find an expert who really knows the engine. Furthermore, it seems like some of the folks don't have access to their cars after they bring it in. If Honda carts off pieces somewhere, and your expert can't study the car, how can he/she make any conclusion?

Chazmo, as far as I know, even if they rebuild your engine, the parts are still yours. I know this was mentioned in another thread. If they don't give them to you when you ask, that shows that they aren't being very diligent, and might be trying to sabotage (for lack of a better word) your case.

Of course, then all you have to do, if you're going to court, is get a subpeona, and I see no reason why a judge would even give them a chance to fight that one.

Thanks Bill,

I spoke at length with the Parts and Service District manager about my securing the engine from my car. He didn't have an answer at first but would do some research. 30 days later I had my answer--if honda pays for any part of a repair they keep the evidence. I mean parts... Sorry.

I will be calling the DSM back and asking for that policy in writting.

Bill, does it really make a difference if that's their policy? Would Scott not have to have something that he signed that said as much? If he didn't sign anything saying that was acceptable, then could they possibly expect this to actually stick?

Wanted to share a story that's somewhat related. A few years ago one of my 400 mile old Pirelli tires developed a "bubble" on the sidewall. I took the car to the tire shop and they told me that its because I hit a pothole. I told them that I'm absolutely certain that I did not hit a pothole. They refused to believe me and I kept asking them to prove it. Finally I gave up and told them I'll pay for the new tire BUT that I'd like to take the old tire with the bubble home with me.

Guess what? After a few minutes the shop manager comes out and takes me to his office, he offered to give me a new tire for free and appologized on behalf of his staff. He said that he'd called Pirelli (only after I told them I'll take the tire home) and they will buy back the tire. I never threatened them or anything, basically just gave up and only told them that I will take the tire back with me.

I wonder if this would work with Honda? The worst thing about such situations is that even if you pay Honda to fix the damage, there is a good chance they don't have a qualified person to do the job right. So, you might as well take the car somewhere else. See if they can find out a defective part responsible for the failure, if not you'd at least know they would do the job right.

Fvck honda dealerships!

I think the base is AHM did a poor job in training, for a lack of better word, the dealers on handling clientel such as that of the S2000.
