It is my understanding that here in California (At least) they will give you a fix-it ticket for modified exhaust (Which includes not having a cat). Now, if they found out that you had no cat when they pulled you over for speeding or reckless driving, then it all will be much much worse.
I've had a test pipe forever. Just drive speed limit 80% of the time (At least) and you will be fine.
