Rear end noise

Default Rear end noise

hey guys, just picked up a 04 s2000 (50k on the clock) 2 weeks ago- long story short, hearing a "whining" kind of sound from rear right of the car, only from 25-40 mph, loudest at 35 mph and dissipates in either direction of that speed. Thigns I have noticed

1.Not gear dependent, does it from 2-6th gear, noise does not change at all wether shifting or not
2. not dependent on grade of road (uphill or downhill does not affect it)
3. Not dependent on load (can take fot off gas pedal, push clutch in, put the car in neutral, does not change tone)

Car has new tires on it (first thought was tire noise), I called dealership just in case it was a diff issue, to see what fluid they put in diff, cant get a straight answer on if they even changed it or not, (long story, but cliffnotes is everyone I have talked to is not helpful). I am taking it in to my local Honda tues mornign (not the one I bought the car from) to have some 75-90 M1 changed into the diff, and to have someone their check out the noise, but just wanted to touch base with you guys and see if it is familiar.

P.S. might need to turn volume up, the noise is everythign your hearing except me shifting and the exhaust (and the static from my crappy camera)
