"Bug" in terms of system bug wherein the system engineers did not completely think of the possible scenarios and impose the appropriate requirements.

You are probably right that the car does not know if the it's actually in gear. But in the case of the the OP, once the car is in neutral the ecu should sample engine speed and delay the engagement of cruise control if RPM is rapidly falling and if it proceeds to stay at idle range withing a second or two then disable the engagement altogether. This should be a straight forward implementation in software/firmware since the fix does not require new hardware.

BTW, your scenario is also true when you step on the brakes. The designer got it right here and disables cruise control.

Its not a simple fix as the car still will not know its in neutral. Try down shifting in any car (even an auto) and see what happens. The car knows when the brakes are pressed and it is used to deactivate cruise control.

I found this "bug" a few years back going down a hill. Boy will that pucker your ass up.
