Sounds kinda like someone did a mechanical over-rev and then traded it in, or else one of the dealer's buddies did it and they sold it as is. The valvetrain was likely toast when you bought it. If you convey that you relied on the expertise of these people who should know better, I think you might do well.

One thing, are you sure it was the spark plug that blew out and fell in to the engine. From an over-rev in an AP1, it would've cracked the retainers and it might've been the retainer that fell into the engine.

Yah, I am sure it was the spark plug. And they said "redlined" on the invoice not over reved, which are different things so it doesn't seem to have to do with the cel... There is no way a cel can be caused by redlining the car... It was deinately the plug because only half of it came out when it was pulled and the coil was melted.. the threads in the head were also stripped from it blowing out.

hmm, redlined...leads me to believe they pulled an over-rev code. however im not sure they have the equipment to do this at crappy tire. Also, are you sure the threads were stripped from the plug blowing out or the mechanic ****** it up?!

it was misfire on all cylinders code.. don't have actually code number tho... they said that was caused by being redlined.. The mechanic at honda ( who put in the new motor) showed me the plug and coil and they were really screwed.. coil was melted and plug was all black and missing part of it

no, sorry that may have confused you.. Canadian tire said that it was from being redlined.. Honda confirmed it was from the plug blowing out

This is not uncommon. There was a TSB about the torque specs on the OEM plugs not being rated high enough to keep the plugs from backing out.

wow.. good luck in smalls claims..

you seem to have a good case, and it's just a matter of figuring out who's fault it is (or more of), and make your case against them in court.

all that law-jargon "standard of care" and "negligence" from the post below:

Dealer did not act in good faith, as they lied to you about the CEL. They had a standard of care when selling the car to you, and IMO they did not fullfill their obligations in fullfiilling that standard of care. They were in a position to know what was wrong with the car, you weren't, so you had to take their word on the CEL issue. You relied on their opinion and they did not do enough to support the vehicle report given to you.
is very good stuff to use. It might even be good to settle with both parties, out of course, after you present your case, because they'll know they will lose, if they are willing.
