This makes me reflect on how incredibly lucky I was when it happened to me. A few years ago I had the stealership change the oil and a few days later my drain plug came out while I was driving around town - how sh***y of a job do you have to do to not re-torque a drain plug? Anyway, I did the slip and slide as my wheels soaked with oil and coasted into a gas station and pushed it in (I turned the motor off immediatly). No knocking, it has almost 30k miles since and no issues. Honda was nice and didn't charge me for the new drain plug.... they didn't seem to think it was that big of a deal. Now I maintain my own car - there isn't much you cant do yourself if you're willing to put the time and research in and it is very satisfying to do.

I agree about getting yourself an attorney - frequently all it takes is the threat of legal action which costs more to defend then simply fixing what broke. "Our word against yours" is a scare tactic on their part and isn't true. I'm not an attorney but it seems that there is proof that they did the work, there isn't any proof that you did anything to adjust or modify that work to cause it to fail. Just my two cents.

I'm in Montana. The oil change was performed at university motors honda in Missoula. They did not use the filter with the numbered band and seemed unaware of a special numbered filter or torque procedure specific to my car despite it being clearly spelled out in the factory service manual. I have already gone to the dealer who referred me to their insurance who told me it was "my word against theirs". Since my only witness is my 5 year old I'm pretty well boned. I keep all paperwork and have the invoice from the dealer for both the oil service and the recall inspection. It doesn't matter. Due to being a single father and working two jobs I let a month lapse before contacting anyone. American honda has been unwilling to help and I can't afford to pay a lawyer up front and no one is willing to take on contingency yet. I was really hoping to have it be oil pump or TCT or something other than a fatal blow. I can't find a decent motor under 100 k and so far no one seems willing to build my numbers matched motor locally.

Right. If they put the wrong filter on, now its their word against your copy of the documentation. You said you had the invoice from the oil change. What part number did they use for the oil filter?

Any chance you can find the old filter out on the road? I imagine you must have a good idea where it came off, and there is probably an oil trail to follow...

Out here in Montana there is several foot tall grass off the shoulder. I went back the next day on my street bike and I could see where the oil started to spray the pavement but never could locate a filter
