My guess only. It will pass but if it's noted that the OEM cat was removed and an aftermarket cat is now in place, they may fail you anyway. I don't know exactly how I would handle your situation if I were in your place but I might just re-install the OEM for the test then re-install the Berk after the test is over.

Make sure there is a heat shield around your cat. Every smog inspection I have had done involved the dude using a mirror to look under the car for a cat. If he sees the cat and it looks stock (heat shield), I doubt he will investigate any further. Just hope it passes the sniffer, which I am pretty sure it will.
