Default What would you do?

Ok so here is a little background on what happened. My car was valet'd about a month ago. I told the valet driver where their parking garage was at and if I could drive it to their garage and he said no. So, than I gave him very specific instructions on driving my car because it is lowered and their parking garage was a block away on a one way street, so he would have to drive around to get there. Few hours later my car was backed in, in front ready to go. Sounds great right? WRONG! The valet driver pulled both fenders out and tapped the rear bumper onto the guard rail while backing it in. Called the Seattle police department 4 times and no answer. He gave me his company's info who I called and file a claim. I also called my insurance company to let them know what's going on. So they got just got done with their "investigation" and said they won't pay to fix the damages because they think I filed a fraudulent claim. I told my insurance company and they said they will talk to the other insurance company to see if they can redo the investigate or get the investigation documents. I gave them a full statement and pictures of the damages and they said it was fraudulent? I also have the valet's drivers license info. My insurance company said they can cover it since I'm not at fault so I am just waiting on what my insurance company says.

So my question is what else can I do? I'm thinking about filing a Better Business Bureau complaint on the company and their insurance company. What do you guys think? I am livid right now.

that's a tough predicament to be in but i'd say just wait to see if they can reinvestigate it...these are reasons why i prefer to park my own car and never valet it...but gl, hope things work out for you

I don't let anybody into the driver's seat except I am next door in the passenger seat. I would never give a valet the keys to my car for exactly the reasons that you have experienced. Sorry to hear - do you have any photos of your car and the particular areas damaged from before the evening that you could produce to your insurance company. Also read your valet stub - my guess is that under its terms of use you have waived all rights to sue for damages sustained at the hands of the valets. Do you have a small claims court in which you could commence an action against the valet company and the particular valet. Might be worth a try. Just don't wait too long to commence the action - it may become statute barred if you leave it too long. Realistically this is what your insurance company should be doing on your behalf - that is why you have insurance!!!

BBB is a waste of time.

You can use your insurance, just make sure it doesn't make your rates go up.

You could always file a small claim for the damage and an amount for lost value, too. If they don't show, you'll "win" though that really doesn't mean much if they don't pay. Still, the minute you file a claim their insurance will indemnify them and you'll likely get it covered.

Yea. It sucks. My insurance company said I can use my coverage and get my car fixed and they have me at "not at fault" so it won't go against me. This is the last time I go to any nice places that has valet only. I figured if it was a nice place with a lot of nice cars being valet why not right? Psssht... guess I was wrong. So, BBB is a waste of time? Thought they were suppose to help?

You're hosed unless you get the valet to admit fault. Making a claim against your own policy will generally impact your future rates.

This serves me a reminder that *knock on wood* if someone admits fault on damages to my vehicle, make sure to have it documented

it sounds like it won't be that big of a deal if the insurance is paying with you not at fault. I would report them to BBB. I am actually surprised the valet company won't hold their employee liable. Where was it at? Things like this can really hurt the rep of a valet company or who ever hired the employee to park the car.

Yea I'm not too worried about my car getting fixed I just don't really want my insurance company to do it and prefer theirs. I am trying to report them the the BBB but I guess their server is down? This valet company/Their insurance company sucks. They never sent anyone out to me to check the damages and just said "nope we won't pay." The company is called Red Carpet Valet. Maybe you should see if the garage has a security camera. Slim chance but it might have some evidence on it.

From what i heard, your insurance will pay for the damages. Than they will attack the valet's insurance company for what they paid you to fix the car. So your insurance is just fronting up the money.
