If the picture is on Photopoint, the condition is that you give up copyright protection to that picture.

Hey Greg-

Sue 'em! Actually, you should mention that they will owe you at least a couple of oil changes/ service intervals if they continue to use it. If they don't agree to those terms, force them to use something else.

Since the guy is selling his S2000, you should just email him and ask for a commission when it sells . Seriously though, I think I'd just ask him not to use it. Too easy to link pix on the net, probably not an intentional offense. Good communications can resolve many of our disputes. Just my opinon.

I think you have additional grounds for suit...

They mutilated your masterpiece. The trashcan somehow got cropped out .

Seriously though, I don't see them having caused you harm. You gave out the pic, and if you had wanted to charge $$ for it, I'm sure they would have gotten another pic.

I just don't see the damages. Just lack of class.

You could give him a scare though... Bid on the car and then refuse delivery since he's using deceptive advertising. After all, the car in the ad is not the one for sale, and that is not mentioned.

1 - it's a dealer. i'd suggest a cease and desist (perhaps with a request for some compensation to make you go away - a car cover?).
2 - i'd suggest you rename that image, change the gallery page to reflect the changes and substitute a new image for gregs2.jpg - might i suggest http://www.stationwagon.com/gallery/pictur..._Ford_Pinto.jpg
