Default softtop questions

I'm looking at purchasing an s and went to look at one this evening that I'm really considering getting. It's an 02 with 29k miles. Pretty much all of the car looked great, but when I put the top down it didn't seem to go all the way down, especially now that I've looked at some pics on here and see what it should look like when fully down. When it was fully retracted, it was probably a good 6-10 inches above the trunk line. The guy said he hadn't had it down in a pretty good while, so could the top just be stiff from lack of use, especially considering that it was probably around 30 degrees F when I was looking at it? Could it just need adjusting, or could something actually be broken?

Also another question not relating to the softtop. The guy has pretty much all documentation to go with the car. He is the third owner and bought it with 6k miles on it, but all oil changes have been done at the honda dealership and he has service records from before the purchase. The first owner owned it for 1.5 years and changed the oil at 3k miles, the second owner owned it for 1.5 years and changed the oil at 6k miles, and it's been changed every 5k since over the past year, "honda oil" used at each oil change. How much should I be worried that, even thought the first 2 oil changes were done at 3k mile intervals, each oil change lasted a year and half? Especially considering that this was the first 6k miles of the motors life when it was still somewhat in break in period.

The top not going down is normal, it will happen when the top is very cold..

My top does that too when it hasn't been used in a long time or its that cold outside. Worst case senario it just needs new elastic straps which are cheap, but I doubt thats the case.

The oil situation isn't ideal, but honestly its not going to wreck the engine. Most cars aren't maintained ideally, at least you have the service records and know exactly whats been done and when. Buy the car and change the rear diff and tranny fluids ASAP.
