If you have the MY07 then yes it is covered by 3 year warranty.

This seems to happen quite a bit. Your top has to much tension or was fitted improperly. My 06 hasn't had this issue yet. It should most certainly be under warranty. This is the same location everyone has issues with as well- should be well known by your dealer.

so i went to the Honda dealership this morning & showed them the tear.. there first response was... no! then i started bitching... now i have to wait for the Honda rep to come out & see if they will warranty it.. it seems that chicago is not really a friendly s2k state. service dosnt deal with to many s2k's they are not aware of tops tearing to much

BS- Honda warranties tops all the time. Your dealer sucks if they told you no. If the rep denies it I would go above his head as this is obviously a defect...

Is there any way to prevent that? I have an 03 and it is starting to show some wear at the same area.

dealerships cannot make that call on a top replacement as it is a grey subject. So if you get denied by a dealership dont throw a hissy fit they are only doing their jobs. It is up to you to pursue the issue. Once the rep looks at it he will make the determination on repairs.

Of all the posts I've read on this forum regarding torn tops, I don't recall anyone being denied.
I've seen a few that did get a runaround but they were also eventually approved.
As I remember it , I've even seen a few that were out of warranty that were replaced free or with a minimal charge.
You should have no ploblem at all with an '07.
