That is only one way. The most common way reported is from an S2000 with this type of intake being PARKED under a heavy rain for a period of time. While parked, the rain falls down onto the top of the filter and collects in that first elbow because the pipe is angled up. Ultimate Lurker posted a long time ago that he thinks that as little as about 100 cc of water sitting in there is enough to hydrolock an engine. As soon as the engine is fired up with that kind of water in there, it is easily sucked up because of the "high cold idle" feature on this car.
"Driving" through a heavy rain is no problem as a moving vehicle reduces the amount of water that falls onto the filter (unless you have a huge gap between your front bumper and the bottom edge of your right headlight). Even sitting still with the engine running (and in a heavy rain and NOT plugging the drain hole in the hood edge) is OK as the running engine can take care of the water as it comes in and won't allow it to accumulate.

i tried to play around with turning the piping to make it aim more parralel to the ground but it would have required more cutting of the plastic around the pipe and i just decided to work with it as is.

The CAI on my RSX was just as low to the ground as the CAI on my s2k. I drove my RSX in the rain plenty of times with no problem. I don't understand, is there a problem on teh s2k I don't understand? One that makes it easier to hydrolock?
