I still can't believe the cops gave you a ticket!! You would think he would have been very apologetic and would not have even considered writing a ticket. That's a pretty damn big screw up!! I've never had a gun in my face, but I'm sure it would stay with me for a good while. Were they at least apologetic after realizing their error?

I don't even think that stopping a stolen car is a gun pullable offense.....is it. If you started a chase i could see, but if you pulled over and did what he said......at the very least, the ticket should be voided. you were right to fear the worst.

I live right off Dougherty and I make it a point not to go through Camp Parks. When I first moved to Dublin, every time I drove my motorcycle through Camp Parks, they would always follow me. I was tempted on several occasions just to get on the gas and leave them in my dust, but common sense always seem to intervene. I don't know what their problem seems to be. Maybe they have too much time on their hands.

As I wasn't there, the following may be a bit inflammatory. How about giving the guy a break? He was only trying to do his job as well as he could. Fortunately for us, he was there trying to get some unlucky bastard his/her car back. Ensuring his safety, he felt the need to have a gun on you. I can understand that it may have been quite a nasty experience, but why run to your lawyer? Hopefully he was professional and treated you with respect. These guys have to deal with trash every day. I give them a thumbs up! Additionally, we all probably deserve plenty of tickets for driving these cars the way we do. I am not looking forward to my first though I certainly have earned it.

I would plead not guilty to the speed and tell the judge what happened. Since they made an error about the VIN they may have made an error about the speed. Most police I know are much nicer than this one. At the least they should have apoligized and offered to get you and your wife medical attention and an escort home since you were obviously very upset.

I work in local government and generally support "the system" however, I can tell you that all of those who are entrusted with protecting us are not necessarily perfect. I would advise you to utilize and work the system. Talk to superior officers, the Chief and or anyone else you can work through. If these folks are political, go that route, someone will listen. They have to have policies on when they can use or even threaten deadly force, etc. Give them a chance to "solve the problem" although short of canning the guy, I am not sure what a "solution" might be, or, in your position, what action would "satisfy" me.
If all this fails, talk to an attorney. Most will give you good advice as to whether or not you will accomplish much.
Good Luck, I would still be trying to get my heart to slow down, or my pants dry.

THAT SUCKS MAN! EVEN IF THE CAR WAS STOLEN I DONT BELIEVE THAT THEY HACE THE RIGHT TO PULL OUT THEIR GUNS UNLESS THEIR LIFE IS IN IMMEDIATE DANGER. YOU SHOULD DEFINETLY TAKE LEGAL ACTION AGAINST THEM!!!!

Listen - the bright side is that you're not going to get a speeding ticket on your record. There are a few options, 1) talk to the guy's Sergeant or LT. explain what happened, and if you play things right he/she will get your ticket kicked during administrative review as an apology for your mistreatment (don't come straight out and say "since I was harassed, I want my ticket thrown out" - then you'll just sound like an ass). 2) Show up to court - there's no way these guys are going to show up and let you give your side of the story to a judge and a full courtroom. 3) Sue the department, and settle quickly. You get some $$, and they'll probably kick the ticket anyway.
