I realize they are different situations, but the similarity is that the previous owner more than likely did the "damage" and the car came to you(and me) that way as certified.

I know that your situation will end up costing a lot more, but I think you also have a better chance of winning the claim. So good luck.

By the way, it took honda about a week to get back to me when I opened up a case - so expect that long.

They denied it...and the Honda Rep didnt even want to talk to me. They said the tech sent him pics of my car and determined from there.....im sooo mad....

ugh...I hate honda's warranty...

Really sorry to hear it grand prix Chalk this up as yet another example of why not to buy a certified used car from honda.

Just curious, is this dealer the same one you bought the car from? The dealer you bought it from should be the ones most worried about losing a customer. They should also be the ones to try the hardest to keep you happy. If this is a different dealer you might want to call the one you bought it from and tell them why you're so unhappy with your purchase. If it is the same dealer (this wouldn't be surprising), then they should be ashamed of their customer service.

Can't they just look up in the ecu log to tell if you over revved? When I had my Rsx-S, they could look in the ecu and they can tell how I was driving the car, when I shifted, what speed I was going, blah blah blah...

If they can, just pray that they didn't reset the ecu and erase the log already. I read everything posted but I still can't understand how they can force you to pay for something that they can't prove you did. I would get a lawyer and do not pay for anything unless your lawyer says so.

If I were you, I would keep on honda about this. They might not pay for the entire repair, but you might be able to get something out of them. After all, they can't prove that you acutally did over-rev the car. You might not get much, but maybe something will come out of it. Just don't annoy them and don't let it die.

I figure I'll pipe in here with my horrifying, depressing, and then glorious story of similar conditions. Before I had my S, I drove a 98 Mitsu Eclipse GSX. I got it from CarMax and got the extended warranty. Most of you won't be aware of this, but the GSX came with a plastic BOV which had been known to lose its pressure over the years and eventually fail. I replaced the BOV (blow-off valve) with a quality aluminum one within 2 weeks of owning the car. Fast forward 3 months later: I'm driving the car with my buddy in it one night, and we end up racing a mustang(hey I'm only 21 at the time). I do NOT overev the engine but something happens, and I hear a ticking noise on the way home. It gets worse and worse until I realize I have a big problem. I had spun a bearing or two in my cam, which would point to an overev situation. Of course, CarMax didn't tell me I had overev'd the engine, they tell me it's cause of the new BOV I put on! Well long story short, CarMax agrees that under normal circumstances they would be obligated to cover a new engine, but because I had replaced my BOV, that it was what caused the problem, and basically told me I was SOL. I responded that I had contacted the manufacturer of the BOV and spoken to numerous mechanics that said that even if I had welded the BOV shut, it wouldn't have hurt my engine; destoryed the turbo? maybe, but no possibility of injuring the engine (with the stock turbo). They didn't care, they basically told me to get lost. Thats when my superhero-lawyer father got envolved and saved my ass. We took my GSX to a High end Ferrari/Lamborghini shop to get fixed, I s*&t you not. The guys at the shop figured out what had happened very quickly: Someone, before I got the car, had jacked the car up with the jack underneath the oil-pan! There was a huge dent in it right where the pickup is for the engine; in fact the dent actually was touching the pickup in one place. They said at higher RPM the car wasn't getting as much oil as it needed because of the damage to the oil-pan, which resulted in a spun bearing. My dad footed a ~$10K bill to put a new engine in, along with some other stuff I needed like brakes/water pump and some piece of my suspension that had been missing when I bought the car! Then he said "ok, now we got 'damages' lets go call CarMax." Not normally a litigator, he sure let the CarMax lawyers have it. They apologized profusely, ate the entire 10K bill, and gave me another $500 for all the trouble. I faxed a copy of the check to the person whom originally had denied my claim, hehe.

Long story short -> These extended warranty places make $$$ by screwing the customers. If I were you I'd get a lawyer and threaten legal action. These people had absolutely NO sympathy for me until they realized that I wasn't just some punk 21yo they could screw because I had no recourse. As soon as we started talking to the real legal people, everyones song changed. We threatend them with more than just our damages too, we threated a punative case and a fraud case based on the fact that they really never had any intention of fulfilling their contract with me. And they folded hard.

Man, I feel for you. I just stumbled upon this thread and was reading through it hoping for a good resolution.

Over the three years I have been here I have read about at least 3 or 4 catastrophic engine failures and slightly more rear diff failures. Most of them had negative outcomes and I hoped your story would be better.

I'm still curious about why the heck the dealer would try to continue to crank a possibly seized engine, or at least an engine that was already known to have broken component(s) floating around in the cylinders. Surely this could have added to the damage already present in the engine and that damage could have made the difference between a rebuild and a new engine.

Well I got off the phone with the Rep and the Service Manager and they refused to over turn the decision..I was so upset but i stayed calm about the whole thing
They said it was clear cut i over reved. They couldnt tell from the ECU but from the damages they could tell it was an over rev. No other damage could cause that. They said i even caused damage to the rocker arm.....i was WTF...i was soo mad...

now im out a motor...I have to pay 752 to the dealer to say its my fault and have my car towed on top of that...
