Do I buy a 2001 or 2003?
I can buy a 2001 for 29K or a 2003 for MSRP. The 2001 was driven buy owner of a dealership. It has 4900 miles but has never been titled. I have no basis for this but the dealership seems sleazy. Other dealership with the 2003 seems ok. Suggestions?

are you kidding me? the 2003 at MSRP is the only way to go.
You are seriously considering buying a used s2k for a potential saving of $4K ??
Let's see, the 2003 has a glass rear window, better stereo with 4 speakers. I don't know all the improvements that have been made (strengthened transmission? recalibrated suspension. etc..)
Besides the "owner" of the dealership has this car? This is another way of saying it's an available demo car. I took out an "owner's" Boxster S and did whatever I felt like with it. I knew fore sure I wouldn't be buying it so I didn't worry about driving it hard. Think about 50 to 100 test drives in the past 2-3 years... 9000K launch, clutch drop, you name it.
Also the warranty is used up.
I mean it's just not worth it.
If you buy a "dealer" car you are just asking for it.

the 01 should come with a considerable discount as 29k just doesn't seem fair. I'd say that if you can get the 01 for 26 than go for it..
btw the stereo sucks in all model years and you'll end up upgrading anyway.. the glass window is nice cause you're in ME
the warrantee should be fine as long as the car is sold as "new" ie never regeisterd (in MA anyway) so the 3 year 36K will still apply
good luck with whatever you do

Typically, the interest rate on a new vehicle should be lower than a used one. For the new vehicle, your 3yr/36,000 mile warranty starts at closer to 0. In some states, the sales tax on a new car is half the percentage rate of a used car. The fact that you know how the car has been cared for since day one will give more peace of mind. Those factors alone would drive me toward purchacing the new car.
Simply put, the $4000 difference in price or (@20bucks per thousand per month=~$80) would really be more like $30-40 more per month on the 2003. And if your monthly payment is a little high, you could always stretch it out 6 more months or complain about the interest rate, then have the finace manager shave off another percent.
Adding a note : The MY2001 car has never been titled to an owner. So they could sell it as new. That is dependant on your state laws in regards to mileage and dealer usage. My bet is that those 4,900 miles were hard ones.
