Cops and S2000's do not mix!! (semi-long)
Me and my friends were down at the Jersey shore just coming from 7-11 at around 10:30pm. We enter some side streets to find 3 cop cars on this one street all gathered up. The cop shines a flashlight on me and the S, then tells me to pull over. At this time I though he was going to give me *hit for doing 35 in a 25. He then tells me that my car fits the description of a vehicle that was racing with... ok get this, a civic!!!
I asked what kind of description he got, their were 4 witnesses (all together) that said they saw a red sports car with a wing. After I got my two tickets, I went to the 7-11 to see if the clerk remembered me and would write when/where I was at the time of the race. But he didn't remember me of course, my luck. So I got some film and took pictures to proof it was impossible to see the color of a car and wing in those extremely low light conditions. My question is, how strong is a witness's statement in court? Cause that's all they got on me, just witness's.
Oh yea, also to add some more drama, the witness's said their 4 year old child was playing IN the street at 10:30 at night. Good respectable parents, eh? 30 minutes later I was pulled over again for no front plate. Can any one offer some help in fighting this?

There are probably plenty of S's that race Civics, Eclipses, and the like. Plus, it sounds to me like you WERE doing 35 in a 25. I would say that unless your car can be POSITIVELY IDed, you shouldn't have a problem. However, you not having a front plate is a different story.

that totally blows. u will need a good plan to defend yourself.
1st video from 7-11, second how the hell can they give u a tkt based on some assumption on you were racing. The probablity that it could have been someone else should be enuff to throw the case out. That is ridiculous. There are same cars all over the place and without the cop actually seeing it how can he give u a tkt?? this makes no sense. you should seek a lawyer.

I'll see if I can get the video from 7-11. But isn't getting a lawyer just to fight something like this overkill. I think I can do a good job and am really into this and would like to do this alone, but if you think the lawyer is well worth it, then well..... How much would you ESTIMATE it to be to fight something like this? Any help would be great. Thanks

I am no lawyer, but if there are no witnesses or positive proof in court you get off. Then again, what do I know. They had no right to give you a ticket on word of some bystanders, I would get a lawyer.

Get a traffic attorney, I have had a few very positive outcomes being represented professionally; you don't even need to be present. If the cop really took you to be some punk racing around, he probably won't expect an attorney to be representing you when the court date arrives. My 2 cents.
