Bad Accident - NEED ADVICE ASAP

Jeez folks,

let's clear this up.

I know that there is no way this could be anyone's fault but my own.

I UNDERSTAND THAT.

I've just never had a claim before and was worried about recouping my losses. That's why we have insurance right?

If you're worried about the ticket, try to go to traffic school, assuming your state has them. If you do, they'll probably clear the ticket.

Jeez, people are cold here. At least your alive, it could have been much worse. As far as insurance goes, they won't give you what you want, but some is better than nothing. Missing time at work will cause loss of wages, but you will be able to recover (I hope). Chances are your ticket will be dropped down, considering its your first incident. Don't get a lawyer, its a waist of money on this incident.

i'll try and answer your questions.
1) An adjuster will come around, they will most likely declare this a total loss. They will probably offer you a check for $X. You should check KBB, edmunds, research local MY01 S2000's that have sold recently (privately and on dealer lots) to validate it is a "reasonable" amount. Hopefully this will be a fair amount and you won't have to fight about the price. Either way this is an "at fault" accident with "injury" (i think this is 2 points in CA) so your insurance may go up for the next 3 years.

2) You obviously feel that the ticket was given to you in error. I would go to court and argue the case...it can't hurt. Maybe you can just take traffice school and get no points.

3) no reason to get a lawyer....suing a police officer works about .0001% of the time.

Most of you guys are assh0les, and its people like you that if I got into an accident that might be my fault, I will make sure it turns out to be your fault, and screw your insurance rates for life. People like you deserve to get sued for $100K for a 3mph rear bumper tap.

Sh!t happens.

An s2000 near my house hit a f*cking filing cabinet in the middle of a highway at night....on an empty highway. Now you are going to say "you are an idiot, there is always a possibility of a filing cabinet being on the road."

Bottom line is.....sh!t happens, to everyone. To all the tools that say he was reckless (which he might have been, but you dont know, so shut the hell up).....he came on here asking for advice, not your retard holier than thou speeches.

Kratos.....get a lawyer. Cops have no proof that you did anything wrong, and the burden is on them. Any lawyer worth his tie, will throw that out of court. Work loss you probably wont get, but you never know.

P.S. This forum is getting flooded with arrogant d!ckheads. Not what it used to be.

Get what is yours from the insurance company.. that's what they are their for. Don't sue a cop for doing his job, that is all he was doing. But probably get the ticket dropped or reduced.

Love it when people talk about things they have absolutely NO clue about.

Look at the photo. If a car slams into soft dirt with both side wheels, it will vault itself, and flip. Simple physics. Now, if you ever drove an s2000, youll know that with anything other than brand new tires, in the rain, the car is a deathtrap. Ive slid through a corner at 10mph with 1" of water. I slid through a flurry shower <.5" at 3mph.

Things arent as cut and dry as you all make it out to be.

well, by maximize, all i see you getting it the check from the insurance for what the car's value is worth as any good insurance company would give. is this what you mean, or do you imply you want more than this? what amount?

i don't know what the "basic rule" is, but in california if i got a ticket i would dispute it in court, the protocol should be written on the ticket. your ability to escape it depends if the officer who issued it shows up to court in CA, they may not even ask you what level of "basic" you have crossed. but if he shows, what do you say when the judge asks you what happened. again, your chances of dropping the ticket depends on how sorry the judge feels for you, or how believable your story is. i don't know what the odds are if you just tell him you were going in a straight line and lost control, he may be asking all the questions us "d1ckeheads" are asking right now.

you should guage your ability to win any case of yours before you hire a lawyer otherwise you will be extra stressed if you hire one and lose, i have seen it happen. i was involved in a case similar to yours, and the jury had no pity for the stressed as they thought it was not enough of an excuse. so think about that before you spend all that extra money on attorney fees.

sorry man, but i would just cut my losses and try to move on, things don't look in your favor if you go down that road.

Thousands of people drive S2000 everyday in more than a "little" water. They do not leave the road for no reason while just driving "normally". Living here in Portland, almost half the year is spent driving on at least a "little bit" of water. Many times it's in full on downpours. When driven according to the conditions the S is perfectly fine in the wet.

I don't usually tear into people on these "crash" posts and I'm certainly not a hard ass by any means. And I am sorry for you that it's happened. But sometimes people just need to figure it out and get a clue. You seem surprised that you get a less than accommodating response when you whine about your circumstances which clearly nobody but you had anything to do with. With the attitude you show I don't know what else you could expect really. And seriously, can't work because you're stressed from getting a ticket? Come on man. Suck it up, learn from experience and move on. It could be far worse. You could be in jail right now for involuntary manslaughter if you had happened to take someone else out. Or you could be in the morgue...

I was relatively stress free about the accident.

but I missed work because of doctor's appointments.

I didn't missed work because i was stressed out about the ticket.

Bottom line: I'll get what I can for the car, and do my best to fight the ticket.

Thanks for your input to those of you that actually gave it. Let's just drop this now.
