01' 1-2 clutch grind denied by warranty/recall

Mine has done it from the very first day. In fact, as I watched them doing the PDI on my car since I even got to watch them roll if off the truck, I heard it grind second gear as they pulled it onto the driveway to head into their service bay since the big semi with the cars was all the way in the back of the lot. I would love to change the fluid, but in all honesty, I'm not going to do something that could possibly allow them to blame me for the use of an improper fluid when my transmission finally gives up the ghost.

I have changed my transmission fluid every 5K since new. My '02 now has 25k and the last two changes have been with GM synchomesh. The fluid seemed to deteriorate, meaning the grinds became more apparent after around 3800 miles on the fluid. It is nice when new, but seems to need more frequent changes. I am going to a full synthetic fluid. Maybe that will help.
