Dude you must be really short to be able to lean an 08 seat back that far.
They are the same height you just have one way back.
Use ap1 or ap2v1 seat rails to keep them both at the same height.
To solve your seat belt problem, you just need an ap1 or ap2v1 seat belt "receiver"
it's one bolt attached to the rail.
The passenger side of the s has less room so you'll likely never get it to lean back that far.

xeuxx thanks for your comment but both of the seats are lean back as much as they can..as you can see there is huge difference between one an the other in height relation. I would like the passenger seat to be as the other one, under the roll hoop cover and not sticking out like four inches... Can someone give me a definitive answer to solve the problem? thanks your your comment.

Almost everyone else is giving you speculation...I have actually done it. I can take some pictures if that would help.

Sorry man, the reclining mechanism is not attached to the rail. It is attached to the seat back. You have to split the seat (remove the back from the bottom) which is only a few bolts. Then you have to deskin the bottom part of the seat back so you can get to the reclining mechanism (not really hard to do but a bit tedious). At that point it is just simply unbolting the mechanism and replacing it with one from a '00-'05 seat, then put everything back together.
I think the hardest part is going to be locating the reclining mechanism. Maybe you can pick up a beat up set of seats from Ebay or Craigslist (I saw a set on Ebay for $200). Then you would have the proper rails, buckles, and reclining mechanism.
I don't have any pics of taking the seats apart. Here are a few I just snapped to show you the passenger seat in my car. It's an '04 with '08 CR seats ('01 rails and buckles)
