Hmm.. yea, the S should have waited to pass. It is the responsibility of the car passing to do it safely. Though... that Porsche shouldn't have passed in braking like that either.

But you also don't expect someone to compound an error with another. The Porsche driver should have checked before trying to get back on track...

He knows he just passed someone so there is a car close behind him...

Isn't this why most instructors tell drivers to go off in straight line and not try to correct. When you go off, correct, and the tires get traction again, you car may be pointed in a direction that may not be the safest to proceed in. In this case the direction was into the path of an oncoming car.

So in situations like this, who is responsible for repairs? And I'm assuming their insurance won't be covering this damage?
