Unfortunately, this crap happens (dealer response to intermittant problems).
Like others have suggested, you could another dealer.
I had similar circumstances with a Ford Contour SVT.
There was a TSB out about "cold shifting". The dealer could not find the TSB and could not reproduce the problem during their short drives, but I kept at them, bringing the car in everytime it occurred. I even printed out the TSB I found on the Internet (new to them at the time in 1997-98). They were surprised I found it and decided to look into it more. The outcome was a new transmission. They saw I was trying to work with them, knowing they could not take any risk in working on a car without knowing Ford would comp them for the repairs under warranty.

This is one thing that amazes me...the dealership is going to make money fixing a car under warranty so why not do it? The answer is in the DSPM relationship to the dealer. If there customer pay to warranty ratio is not where it is suppose to be they have a hard time with warranty issues where as a dealership that is in good standing can make it fly without a problem. The solution is to find such a dealer, like its been said before find another dealer.

Only other warranty issue I have had is that they have replaced 3 headlights so far!
Yeppers.... 3 of em!

As others have said, I would try another dealership. If it was a Honda you could go to Ganley Honda.....could they do a warranty repair on an Acura??

Well, met with the district guy Friday.... He drove the car for 20-25 minutes and about 50 shifts into 3rd gear without any problems...
Got back to the dealership.... and the Acura service manager through a proposal onto the table...
He is going to order a 5-6 gearset (service bulleitin) and a new tranny.... I will drop my car off in 2 weeks and he will drive it in the morning... if he has problems with it, they will do the service bulletin... if not, they will throw a new tranny in the RSX...
Now how can I pass that offer up!!
Finally... getting somewhere with them!!!

The RSX is currently at Acura getting a new tranny under warranty at 51k..... pick it up tomorrow evening!!!!
