OK I got my first speeding ticket since I got my S2000 and I had a few questions to ask you guys.

First of all, the ticket is for going 41 in a 30. I couldn't believe he gave me a ticket for this because I was completely in the flow of traffic.

After getting the ticket, I asked him to show me his radar recording proving I was going 41. He said he had already cleared the radar. Can I use this fact in court?

The thing is that I know I was not going 41. I had a passenger in the car with me and I was showing him my digital speedometer an my 9000 RPM redline. Both of us sawthat the astest speed I was at was 36. The fact that he did not show me his radar and that I have a witness saying I was going 36: will this help me?

One last thing: the place I got the ticket is right after an overpass with a severe downhill. He clocked me about 50 feet ater the base of the decline. I was pumping my brakes and still couldn't get down to 30 mph. Will this situation help me?

In conclusion, I admit I was speeding but only by 6 mph. I like to take responsibility for my actions but I was only 6 mph over and the guy as an asshole after he pulled me over. The fact that he didn't show me his radar and that I was going down a hill and was in the flow of traffic are the only things I can think of to contest the ticket.

Should I a) plead guilty and take defensive driving
b) contest the ticket in court
c) contest the tiket by mail
d) hire an attorney

I am having regrets about buying a yellow S2000.

Also, will 42 in a 30 affect my insurance?

Dude, just get a lawyer or hire Ticket Clinic. If you go to court, plead No Contest.

I always take my tickets to court and hope the cop doesn't show. Then the ticket is dismissed. That may not work for you in a smaller town, where the cops actually care about showing up to court...it works in Chicago, though!

41 in a 30 is not a bad one, I would hire a lawyer, it'll cost you a couple hundred bucks, but your record will be clean.

Good luck!

always, always, always, always, always,ALWAYS fight traffic tickets!!! best case you get off scott free, worst case you're no worse off than pleading guilty. on average when i fight i get at least a fine and/or points reduction.

history: 4 tickets pre-s2k in a 5 year period, no convictions.
6 tickets in the past year with my s2k, 1 conviction (fine and point reduction), 2 more on deck to fight!

If you got the cash for a attorney, go for it.

You easily have the case. The cop should'nt have cleared the radar and he basically picked you out of a crowd because you have a sports car.

The cop shouldn've have a case, it's all you.

I have a question about insurance.

I heard somewhere that speeding by 9 or under does not affect insurance rates. If I can get the speed reduced to 38 in a 30, would my insurance go up? Does it depend on the insurance company?

If I can get this done with the help of my witness, I would just pay the ticket. Otherwise, I'll do defensive driving. That won't really be any more expensive that hiring a lawyer.
