Default SPEEDING TICKET & Courts: If cop doesn't show..

Ok, i just got a ticket in southern california and i was wondering if i go to court and the cop doesn't show, is the ticket dismissed? that is if i plead not guilty..

It really depends on the judge, but yes, in a lot of traffic cases, the judges would dismiss if you subpoenaed the officer and he's not shown.

First you will need to go to court to get a trial date. Then if on your trial date the cop that wrote you the ticket does not show, your case will be dismissed by the judge.

I had an illegal left turn ticket about 8 months ago in Westminster city, on my trial date the cop did not show up, my case was dismissed. I got the bail refunded in about 6 weeks.

You lucky Californians. Where I'm from, the dismissal depends largely on the mood and whim of the judge.

He's mistaken! It does depend on the judge, it's not a mandatory dismissal.

I think this rule varys state to state. Ask a lawyer or someone about this rather than listening to people on here. No offense to people's advice, but with legal matters I think it would be better to check with someone who knows the law in your area. Often times there are a lot of myths surrounding speeding tickets. Here in NC, the whole no show cop thing doesnt work.

in nj the prosecutor said if the cop isn't there they will reschedule your date.

It depends...my son got a ticket the officer didn't show but the ticket was his affidavit and my son got the points and had to pay the fine. That's here in Michigan.
