I have received a 4 point ticket for passing on the right. It is illegal in NJ and most states.
OK, now we are getting somewhere. Thanks. Can you please explain to me (who lives and drives in CA, where our Vehicle Codes explicitly permits "passing on the right" (under certain conditions)) what happened? Under what conditions were you cited for "passing on the right"? I still don't understand why it should be illegal, but that's another issue. Right now, I'll be happy just to understand what "passing on the right" means.

"slow moving vehicle" Probably refers to vehicles with the triangle. Farm equipment etc. As i read the CA law it legal to pass on the right if there is a legitamate lane there.

Unless your trying to amke one lane two? Which is obviously illegal.
I have no idea what it means to "make one lane two", so whether it is illegal or not, or obvious or not, is a mystery.

In California, if a lane is wide enough for two vehicles to drive abreast then it is legal for them to do so, and it is legal for one vehicle to pass another on the left whilst they're in the same lane. One does not - DOES NOT - need to move to another lane to pass another vehicle legally.

Why is this idea so difficult to absorb?

Were talking about a highway with marked lanes so what relevance is it on a side road that is unmarked?

Let's try this one more time.

In California, if you're on a highway with marked lanes and a lane is wide enough for two vehicles to drive side-by-side it is legal to pass another vehicle on the left while staying in the same lane as that vehicle and it is illegal to pass another vehicle on the right while staying in the same lane as that vehicle.

By the way, the original discussion was not specifically about highways with marked lanes, nor specifically about highways; it was about passing on the right under any circumstances.

I know it's taboo to pass on the right hand side, but it just makes sense for people who drive "efficiently" to take the quickest route and if the slower lane(s) are open... why not drive there?
Now I wondering if your just trying to get a rize out of people or if your smoking crack.

Seems to me the original post (above) was rather or not you can pass in the right hand lane since he's talking about a slower lane(s). What kind of moron would try to pass in the same lane on a highway, this would obviously be reckless driving. Now if your talking about someone makeing aleft on a one lane (on one direction) road then I could imagine you can pass on the right so long as you don't go off road like the law states. Seems to me your the one confused by the law, I think its pretty clear.

Just digging up an old thread that I posted years ago about this same topic:

What does "passing on the right" mean?

Based on the posts from Europe, it seems that over there, even when you are in a separate lane, you cannot overtake a slower moving vehicle on your left.
