Why in the hell would she sue? It makes no sense from a legal standpoint; such a claim probably wouldn't even make it to the docket in small-claims court.

She would make the claim in the hopes his insurance company would throw in some extra cash for "medical." If he has good coverage with a reputable ins company they'll handle it for him. I doubt she would want to sue him personally--as a student he likely has no real assets to go after. (No offense to students! )

I deal with this everyday. She can claim all the bodily injury she wants. However, a biomechanical analysis (conducted by your insurance adjuster) will reveal there is no mechanism for injury and will deny the bodily injury claim to her, or her dirtbag attorney.

I wouldn't worry about it. Chances are that she's reasonable and will not make a fuss about it. If she does, this is why you have insurance. Your contract with your insurance carrier likely provides that they are obligated to indemnify you in the event that you are sued for any damages arising out of an auto accident. This means that they will pay for your legal defense and any damages awarded to the plaintiff to the extent that the damages are less than or equal to your policy limits (which, given the minimal damages, if any, are likely greater than any potential recovery). I also have more faith in the legal field and doubt that she would be able to get an attorney to represent her if she has not sustained any medically documented injuries. It's just not worth an attorney's time to pursue if there is no medical proof of injury.
