Any advice guys?
Hey guys, I got a ticket a little while ago, for driving 62mph in a "45mph", I tried to talk myself out of it, but he wouldn't give in at all, besides I deserved the ticket. The next day I drove back around very cautiously through the area scanning everywhere, wait, how come there is no speed limit sign??? I looked everywhere, there was absolutely no sign indicating the speed limit, the first speed limit sign was for 55mph but that was after the area where I was ticketed and pulled over? Being that the california speeding violation 22350 states something like 'driving too fast than the present conditions allow' wouldn't the speed law be up to the driver (within reason of course I would say +5mph). My question is, is there any law stating that there must be a sign to instigate a speeding violation, and what else should I say in court, I have pictures, of the entire area every 30ft from where the street starts. I probably was driving too fast, but the first speed limit sign was 55mph on an uphill road, I figured 60mph would be close to the limit. Guess I was wrong .

Unfortunately my shaky memory tells me that if there is no speed limit sign posted, the limit is 45mph. At least around here.
My first ticket in my S was for 62 in a 50.... pshh... I was just enjoying my S ya know? Basically full throttle until the end of 2nd gear, which to me is the speed limit in most places.
Let us know what happens with your ticket.

While there is some defaul speed limit, a lot of judges will throw out tickets if there isn't a posted speed limit. I'd think you'd have a good chance at beating it if you go to court.

It doesn't hurt to fight a ticket. Even when I've lost the case I've had judges reduce the fine if they could kind of see my side of it. If I were you I'd fight it, go into court and say there was no posted speed limit and you were going by the "basic speed law" which dictates the limit is whatever is safe for conditions. Take some pictures of the area to support your claim that you were going an appropriate speed and see what the judge says.
