not arguing the law.
my buddy in HS was speeding down a back road, not anything crazy just 10 or 15 over. Cop coming the other way turns around speeds after him and looses it on a turn... on all out man hunt insues, he was charged as if he purposely ran the cop off the road even though he had no intention and wasn't there.
Cop looses it in his cruiser on a dry road and it's his fault???
Needless to say most charges were dropped witha good lawyer but it cost him big...

Would the driver of the Ferrari have pushed his car past his own limits if the other driver had not been racing him and therefore encouraging/egging the Ferrari driver to drive faster?
Look, we all drive fast from time to time. But we are responsible for whatever happens because of that. And refusing to accept responsibility for our own actions as a society is part of what has caused the current economic situation - People refused to accept responsibility for their decisions to sign ARM loans, and banks refused to act responsibly about how and to whom they offered the ARM loans.
Point is: If you want to play the game, fine. Play the game (I don't like it, but whatever). Just be willing to pay the price to play.
