Did you cross a solid line as you went around the turning vehicle?

No, The street that I was on was a BUS ROUTE...so the lanes are wider...but still one lane....as the vehicle in front of me stop to take a left...I am bearing right....about 5 to 10 degree..still going straight to pass.

What do you mean by "INSURANCE LAWYER"....isn't just calling my insurance company and filing the insurance claim enough.

Sam, if the Xterra had a stop sign on its road, its definitely its fault, not yours. You have the right of way, and no stop sign. I experienced this the hard way with my legend last time. I had the stop sign, I stopped, but kinda a bit too far out, and this shitty civic hit my front bumper, and it's still my fault, because I have the stop sign. If you have stop sign, no way you can win, but in this case, you will definitely right, because you have no stop sign, whatever the xterra driver said, you still right. Because of the STOP SIGN!

Well, my insurance company is ruling me not at fault. Which is a good thing...but not sure if there are things to come from the other insurance company. But anyway...that's why we pay insurance companies....so they could fight it out.

THANK YOU ALL FOR RESPONDING TO THIS POST.

Now I just need to get it repaired ASAP.

Ken(S2Krazy)

I am bringing it to the LUPO AUTO REPAIR SHOP you recommended. Hope it turns out right.

p.s. keeping my fingers crossed.
