Sorry to hear that, Sam, but it sounds like a no-fault to me, if it's not the Xterra's fault. Passing on the right is OK if the car in front's making a left turn. Your biggest argument would be that the Xterra crossed the double-yellow line. A friend of mine got a ticket because he crossed a double-yellow line to take a left turn coming out of a parking lot.

Sorry to hear about your accident. I don't know the rules there but it sure sounds like what she did was illegal and if what you did wasn't, then how could it possibly be your fault?
Have you thought about consulting an attorney? Might cost a little more, but would be worth it if it keeps your premiums down.

Sorry to hear about the accident Sam. I think that you should just give up on that car and buy our black one

I'm here. My car is parked on the street. What do you mean the black and the blue? Don't go to a body shop you don't trust! I've seen way to many S2000's that people have tried to sell here with overspray.

So, Sam, what you gonna do then? pay the money out of your pocket or you are gonna go thru the insurance ?? well, if you are going thru the insurance, I am sure you could get some parts for free... just need to deal with the body shop before you bring the car in...!!
