so here's a question and i'm a bit confused on this matter....but if they do total the car.....the expenses that are owed to me should equal how much the car is currently worth.....am i correct? totally confused..

when i spoke with the claims adjuster (from progressive)....she mentioned that collision is capped at $10,000. if the damage is over that amount, then my own insurance (ameriprise) is responsible for the remaining amount. but that's retarded. i'm not at fault....why should i be paying my own deductible? again, totally confused...so maybe you guys can help me understand

Insurance agents are shisters, They will try to get away with paying as little as humanly possible. I would not sign anything unless it says it will cover the entire cost of the car. Like I said earlier if they try to screw you, or are acting funny I would contact an attorney. I can ask my brother to look at your case if you want, let me know.

I only got $3000 from total my old 1990 Talon. Than I buy the car back for $250. Sold every possible parts I can and get about $2000 more. Than pay $50 for the junk to take pretty much just the shell. He dragged it on the flat bed out of my garage.

i would call progressive and ask them wtf they are talking about, there is no reason your insurance should have to pay at all,.....that would mean you would have to recieve two checks from two insurance companies and that is even more retarded, flex them muscles when you talk to them and make sure you use what pj calls "the dad voice"

I talked to my brother this morning, he said leagaly they only have to cover the low blue book value of the car, if they do total it out. So It all depends on how much you still owe to see if its worth it. He said otherwise you would have to go to court to get anything more. He said people who this happens to, that owe more than the car is worth often go down the personal injury path to recover the entier cost of the car. Sound shitty I know but thats the way the insurance industry works.

just got an email from my adjuster.

"Nevada state law only requires a minimum of $10,000.00 for Property Damage limits. If anybody's damages exceed our $10,000.00 limits, we can not pay above his coverage maximum on his policy that he purchased. Our customer chose this policy limit, but not everybody has the same limits in Nevada. I have not been notified yet if your damages will exceed the limit, so it might not even be an issue. I hope that answered your question."

looks like if it does exceed $10,000......i'll probably get a lawyer and sue the guy
