Default Stick This, Judge

Monday morning I'm hand carrying my $371 ticket bail and my "Trial by Declaration" letter to the Moreno Valley courthouse. Hopefully I'll have the same success others have had by following the "ticket assassin's" advice.

Why should you get out of a carpool violation? The rules are pretty cut-n-dry aren't they? Did you not know you were in a carpool lane? Forgot you were alone????

Do the crime, pay the fine.

Not if he is doing the "Trial by Declaration" route. You have to pay the fine in advance and submit the paperwork. Then you have the opportunity to write a letter to the judge pleading your case. The police officer also has to write a letter for the judges review.

From there the judge can either dismiss/reduce it (refund).....or hold you accountable and you lose the fee you already paid. If you lose, the next step is to have your face-to-face court date (which is our right).

The hope in "Trial by Declaration" is that the cop will not write the letter and you win by default. Even with a good argument there are no guarantees. Depends on the judge, and how badly the city needs the revenue.

I learned this all from the ticket assasin a few years ago.
