Actually my nose is way more sensitive to cigarette smoke that it ever was before. I smell it even when my wife doesn't. I can pick it up on the air when walking around the neighborhood even though I can't see someone smoking - usually across the parking lot or at least a couple hundred feet away.

I smoke cigars (duh) but they don't bother me - neither do pipes. Cigarettes, on the other hand, do. I have been drunk and said what the hell and borrowed a cig or 2 and even then it was like I can smell them a mile away (distance exaggerated for effect )

Balcony and patio are limited common elements.
Inside homes it could be classified as a nuisance and banned under existing condo bylaws against nuisances. It's been done before in the US (Colorado and California and more), with different levels of bans and phased approaches (grandfather in current owners, ban future owners). And the subjects of the bans have lost consistently in court.

When apartment shopping. We stayed the Hell out of ones that reeked of Indian food.
I always wonder why people making food that has a strong smell to it never understand the concept of a proper exhaust!!
