Yeah, your building fails. I disagree that the smokes dissipates immediately upon extinguishing.
In an outdoor open-air setting, the smoke dissipates nearly immediately.
If some has creeped into your house, it will stick around for a few minutes, but the chances are that it's so diffuse it wouldn't even register on a measurement device much above background pollution.

At this point, it's a smell - like BBQ or indian food being cooked downstairs.

You nose is faulty. Your sense of smell has been compromised due to years of smoking.

Actually my nose is way more sensitive to cigarette smoke that it ever was before. I smell it even when my wife doesn't. I can pick it up on the air when walking around the neighborhood even though I can't see someone smoking - usually across the parking lot or at least a couple hundred feet away.

The problem is, these people are HARD CORE ANTI SMOKING people. They actually said "I don't care what we have to do, let's ban all smoking on the property. Have the lawyer get started on whatever we need to do."

"Well, we can more easily impose our will on balconies because they're limited common elements. That will force people inside, which will cause more people to complain, then we can ban that, too."
Is the balcony considered a common element?

If it isn't, they may have a constitutional issue in enforcing the ban. The condo association has no jurisdiction inside your home. I am guessing they would loose a lawsuit in trying to enforce any such rule.
