it should fall under the 3yr/36k warranty. i bought mine used and when i pointed out a small tear they volunteered to replace it under warranty. if they give you any crap, go to a different dealer or contact honda customer service.
i have read posts from board members who have had tops replaced out of warranty at no charge or a partial compensation.

I called honda, they sent out the regional service guy, he looked at it for a second, and worked me. Said it could have happened from something scratching it on the outside, like a rock, and since I didn't have the extended warranty, and don't service my car at a honda dealer (thus making me a bad customer) that they would give me a 20% discount on the repair and replacement.
It's on a 03, and I had, 38k miles on it.
The tear in the top is over a spot where the inside frame rubs when the top is put up.
I've resigned to the fact that Honda isn't going to step in and do anything. I've found a replacement top for about $835 shipped (it's canvas which I prefer).
I've read about it being a PITA to replace yourself and found people around that will do it for nearly $400, bringing the total to about half what Honda charges for a factory replacement.
I've heard rumored that this is the last model year that they will be producing. At any rate, I love having a car that rev's to 9k so I'll fix it and keep it for years to come. In the mean time, I found it helpful to get some iron on color matching stuff at a local store, and used that.

I think many of the tears our cars experience are due to lowering and raising the top in colder weather...even here in Florida.
I also think that leaving the top down for days at a time and then raising when the top has not been warmed by the sun can cause tears.
