Tree falls on car

Default Tree falls on car
















This happened this morning while I was at work , my wife called me and this is what she saw. I rent the house right now.

My question is who do I file an Insurance claim agains , my car insurance or the landlord's insurance.

P.S. The landlord was informed by the owners to have this tree cut because of wood rot.

My roommate is an ins adjuster and he says is your car ins that would have to cover it. Sorry man.

I told him that you said the tree was rotted and he said "Only time the tree is covered by the property owner is if it was dead prior to the loss and it appeared clearly dead"

He said you may have a strong case if you can prove the tree was dead or rotted before it fell and that you may want to have your ins company cover it ans have them subrogate the cost to his HO ins. Your ins will pay to have tree moved too. Don't let them tell you that you have to pay for it.

Not that I would be happy but thankfully it wasn't the S!! good luck with your insurance.

I saw your PM, you can go and claim it under the HO policy I am sure He has a Liability coverage up to 300k if they give you a hard time to pay, then you can claim it under your Insurance under Comprenhensive part of the auto policy assuming you have Comp/coll coverage pay your deductable and have your auto insurance carrier file a claim under the HO and get your Deductable money back.

Comprenhensive claim DO NOT affect your Premium

Yeah, he is right on.. act of god unless you can prove the tree had issues prior.

Call you company, it's covered under comp. If they feel that there is evidence that the tree had issues they will go after the at fault person.

Damn man that sucks, It really doesnt look like that much damage.

I had a tree fall on a project truck that I was working on at my mothers house about 4 years ago, It took alot of fight but I ended up getting her HO insurance company to pay me for the truck. It was totaled. But I didnt have car insurance on it cause it was a race car so mabie that had something to do with it.
