Man that REALLY sucks! I would think you would able to fight that in court as its usually the person who rear ended the others fault (even if they were riding your ass in the snow). I wish you luck and hope it turns out ok for you.

This does not add up.

I've always heard that you are not at fault if hit from behind. It is the responsbility of the person behind you to maintain a safe distance.

I was stopped in traffic on Glennwood and was at the front of a 4 car chain reaction accident (my car got rear-ended). The cop said that the person who starts the chain reaction rear-ending is responsible for all 4 cars that were damaged. (Luckilly, I just got a 1/2 inch barely visible wrinkle in the bumper cover)

What did your lawyer say about that? Anyone else have any knowledge about this concept? Am i clueless about it?

skid marks can mean "lines in the snow caused by your tires"

id hurry up and take pics of the scene of your "skid marks" before they melt

the other thing is whats the speed limit? 25/35? 17 in a 25 even on a sunny day isnt against the law

P.P.S My belief is that the cop is not the deciding person from a legal perspective, you can talk to a DA out of court about it and they can make adjustments... and finally a judge can make a decision in court. Some joker 6 months out of high school and traffic cop school is not the final authority on very much.

Brian is right, get pictures of everything. It seems that the most important pic would be ones showing damage/marks on the minivan.

In my experience it's always the person who rear-ends who is at fault. I guess the cops donuts were getting cold

I couldn't take pictures of the snow as it was on a regularly driven road...there were atleast 20 cars that drove over the area where i got bumped and whatnot in a 5 min timespan after i got knocked. I'll try to get out to the auto body place today and take some pics. They called and said they would do their best to get the estimate and start working on it today. I told them we would be paying out of pocket, it seemed to bump their interest in working on it.
